Contest Rules

These contest rules are specific to the above contest conducted by Entercom San Francisco, LLC d/b/a KBWF (collectively, the “Station”).  Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well.  A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 201 3rd St., Suite 1200, San Francisco, CA 94103 during regular business hours and on the contest page on the Station’s website at www.957thewolf.com. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest.

How to Enter

1. No purchase necessary.  Must be at least 21 years of age to enter.

2. There is one way to enter this Contest.  Beginning on June 24, 2009 at 5:00am and ending on July 22, 2009 at 05:00PM (PST), 95.7 The Wolf listeners can log onto www.957thewolf.com, then click on “Colgate Country Showdown” link on the contest page, you will then be directed to the official entry form. Only official entry forms will be accepted.   You will need to complete the entry form with your band name, the names of your band members, city, zip code and dates of birth and submit it in one of the following ways, together with a song described in detail in Section #5 below:
i.   Audition in person at one of the live auditions which will take place at the following date/times:
 a. Wednesday, July 2nd from 9-11pm at The Saddle Rack, located at 42011 Boscell Rd, Fremont, CA 94538
 b. Wednesday, July 22nd from 9-11pm at The Saddle Rack, located at 42011 Boscell Rd, Fremont, CA 94538
ii. Recorded submissions (CD, MP3, or cassette) may be submitted in advance to guarantee a spot in a live audition.
iii. Station will contact participants within 24 hours of audition to confirm guaranteed spot.

3. The CD, MP3 or cassettes must include a song of no more than Five (5) minutes in duration, sung and performed by all of the entrants named on the entry form. In the event that any CD/cassettes and MP3’s submitted that exceeds 5 minutes, Station judges will only consider the first 5 minutes in this contest.  BY ENTERING THIS CONTEST, THE ENTRANT IS REPRESENTING TO STATION THAT THE USE AND DISTRIBUTION OF SUCH AUDIO WILL NOT VIOLATE OR INFRINGE UPON THE RIGHTS OF ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, COPYRIGHTS OF OTHERS.  By submitting audio, Entrants agree to indemnify Station should any representations and warranties in these contest rules prove to be false or inaccurate.

4. Entries & performances must not contain any indecency, profanity or obscenity as determined by Station in its sole discretion. KEEP IT CLEAN.

5. Failure to properly address the envelope or failure to secure both your entry and CD or cassette in a sealed envelope or failure to email your MP3 and entry form all in one email may result in disqualification in this contest, in Station’s sole discretion.  Sponsors are not responsible for lost, misdelivered, delayed, misplaced entries or improperly sealed entries in which the entry cassette and/or CD is separated from the entry form.   Entries must be legible and contain all information required.

6. WHETHER OR NOT SELECTED AS A  WINNER OR FINALIST, ALL ENTRIES & PERFORMANCES BECOME THE SOLE PROPERTY OF STATION AND MAY BE USED BY STATION IN ANY MEDIUM IT DEEMS DESIRABLE NOW OR IN THE FUTURE WITHOUT ANY COMPENSATION TO THE ENTRANT, HIS/HER PARTNER OR ANY OF THE PERSONS WHO APPEAR IN OR PROVIDE MATERIALS FOR THE SUBMISSION.

7. By entering in this Contest, Entrants acknowledge and agree that they will comply with all local, state and/or federal laws or other associated rules and regulations associated that may be applicable.

8. By entering this contest, entrants acknowledge and agree that Station reserves the right to post some or all of the entries on the Station’s website.

9. Each entry can be made by a solo artist or a group of no more than seven people.  All performers shall be deemed entrants in this contest and must satisfy and comply with the entry requirements set forth in these contest rules in order to participate. 

10. Only one entry per person or band will be accepted.  Any entry which includes the one or more of the same people as another entry will result in the disqualification of all but one of such entries -- and the decision of the Station as to which to include will be in the Station’s sole and absolute direction and is not subject to appeal.

11. By entering this Contest, Entrants represent warrant and covenant that they have obtained permission from all performers consenting to submission of the Entry, participation in the Contest and agreement to the terms of these official Contest rules.

12. By entering this Contest, Entrants represent, warrant and covenant that (i) except for music performance licenses available to the Station from ASCAP, BMI and SESAC (which does NOT include use of another party’s performance (i.e. karaoke style), (ii) the content of Entry will not violate or infringe any rights of third parties; and (iii) Entrants have the right and authority to grant the to the Station rights to the content provided in the Entry.  By entering this Contest, Entrants agrees to indemnify, defend and hold Station harmless from and against any claims, expenses proceedings, suits, actions or costs (including costs from reasonable attorneys’ fees) of any kind or nature incurred by Station on account of a breach by Entrant of any of their representations, warranties, covenants or agreements as a result of Entrant’s participation in the Contest.

13. Station retains sole and exclusive possession and retains all rights to use any Entry, or any part thereof, including but not limited to the musical performance submitted with an Entry, indefinitely in any advertising, promotion or use of any other kind  including, but not limited, to on-air usage without any compensation to Entrants or any third parties.  The aforementioned stipulations apply to all winning and non-winning Entries.  Station is not responsible for any costs associated with submitting any Entry or any costs arising out of participating in the Contest or failure to adhere to official Contest rules.

14. All entries become the property of the Station and will not be acknowledged or returned. Entries received that are mutilated, tampered with, illegible, or from ineligible entrants will be void.  Entries that are determined to be fraudulent will be void, and the person making such an entry barred from further participation in that contest. Incomplete entries may be disqualified in Station’s sole discretion.


How to Win

15. On or about July 23, 2009, the Station will select up to ten (10) Entries (each, a ”Finalist”) from all timely entries  performed. Entries will be judged by judging panel at live audition. All judgments will be at the sole discretion of judging panel & the station.  Their decisions shall be final and non-appealable.

16. Finalists will be notified by phone July 24, 2009 before 5:30pm and will be required to sing live on July 29, 2009 at The Saddle Rack, 42011 Boscell Road, Fremont, CA 94538 to have the opportunity to compete for the Grand Prize (“Finalists”). THERE WILL BE NO CHARGE FOR FINALISTS TO ATTEND THE GROUND PRIZE EVENT.   Finalists must perform live and must be present to win.  Only the actual entrant and the actual persons named in the initial entry form may perform (irreconcilable break-ups are at your risk).  Check-in will begin at 7pm.  Any Finalist not checked in by 7pm (PST) will be disqualified.  Finalists’ spots are not assignable.  And show a valid government photo I.D. and sign a liability release agreement and/or other forms prior to being permitted to compete in the final round.  Event will begin at approximately 3pm and continue until all finalists have performed the same song that they performed in their audition. Finalists must remain until the grand prize winner is announced.  A panel of judges will judge finalists’ performances in order to determine one (1) Grand Prize winner, subject to verification of eligibility and compliance with these contest rules.  Finalists will be judged based upon any lawful criteria that the judges deem desirable.

17. Station will only be required to leave one message on one of the numbers provided by the Qualifiers and Second Round Qualifiers.  If no answer, response or answering machine is reached, Station will not be obligated to attempt any further contact.  However, Station reserves the right, in its sole discretion, to attempt to contact any entrant more than once and shall not be required to attempt to contact all entrants an equal number of times or in the same manner/mode. 

18. If a Finalist does not timely register for the Grand Prize event as set forth above for any reason, that selected Finalist will not be eligible to participate further in this contest nor eligible to win any prize in this contest and shall not be entitled to any alternative prize or compensation as a result.  In such case, the other Finalist will automatically be deemed the grand prize winner in this contest (subject to verification of eligibility and compliance with these contest rules).

19. Finalists hereby agree to strictly follow all instructions and directions given by the event staff at the Grand Prize Event and understand that any intentional failure to comply with the processes, procedures and instructions at the Grand Prize Event may result in immediate disqualification, in Station’s sole discretion. 

20. Finalist performances must not contain any indecency, profanity or obscenity as determined by Station in its sole discretion.

Prize(s)

22. The recognized winners of the Performance contest (subject to verification of eligibility) will be each of the individual performers whose name was included in the initial entry form.

23. Qualifiers will not win any prize in this contest, unless they are selected as one of the two Second Round Qualifiers.

24. Second Round Qualifiers in the Performance contest will win no prize other than an opportunity to compete in the Grand Prize Event. 

25. One Grand Prize will be awarded to the verified Performance winner(s) in this contest.  At the Grand Prize Event, Finalists will compete for a spot in the Colgate Country Showdown California State Finals.  Total grand prize value is $0.00.
