OFFICIAL RULES
ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. Sweepstakes (the “Sweepstakes”) is open to legal residents of California, who are eighteen (18) years or older at the time of entry. Employees, officers, and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of they reside) and members of the same household, whether or not related) of San Francisco Giants Enterprises LLC, Entercom San Francisco, LLC dba KBWF and the Kenny Chesney Tour (together, the “Sponsors”), and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate. The Sweepstakes is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted by law.
HOW TO ENTER: The Sweepstakes begins at 12:01 am Eastern Time (“ET”) on May 18, 2009 and ends at 11:59pm ET on June 8, 2009 (“Entry Period”). There are two ways to enter: online, or by mail. No other method of entry will be accepted. Limit (1) one entry per person/e-mail address/household, regardless of method of entry.
1. Online Method: During the Entry Period go to 957thewolf.com and click on the Sweepstakes banners, buttons and/or links to buy tickets to the Kenny Chesney Sun City Carnival show at AT&T Park on July 18, 2009. By completing the purchase through this link, you will be automatically entered in the Sweepstakes. 2. Mail-in Method: If you do not wish to enter online, you may enter the Sweepstakes by hand-printing your name, address, city, state and zip code, day & evening telephone number (including area code), date of birth and e-mail address (optional) on a standard size postcard and mail to: AT&T Park – Attention: KBWF Kenny Chesney Sweepstakes – 24 Willie Mays Plaza – San Francisco, CA 94107. Sponsors will use e-mail addresses provided via the Mail-in entry method for prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon entrant’s provision of this information. Mail-in entries must be postmarked by June 8, 2009 and received by Sponsors by June 15, 2009 Mail-in entries become the property of the Sponsors and will not be returned.
RANDOM DRAWING: The potential winner of the Sweepstakes (the “Winner”) will be selected by random drawing on or about June 16, 2009 from all eligible entries received by the Sponsors. The decisions of Sponsors, including the selection of the Winner, are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received. All prizes will be awarded. Limit one (1) Prize per person, family or household.
PRIZES: One (1) Prize Will Be Awarded. The Winner will receive the opportunity for the Winner and a guest to meet Kenny Chesney at the Kenny Chesney Show to be held at 5:30 on Saturday, July 18, 2009 at AT&T Park, San Francisco, California 94107 (the “Show”), two (2) VIP sandbar seats to the Show, two (2) CD’s signed by Kenny Chesney, and one (1) parking pass to the Show (the “Prize”). Estimated Retail Value of prize: $ 520 TRANSPORTATION NOT INCLUDED
The Winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals, taxes (including income taxes) and gratuities and other expenses incurred by accepting the Prize are the sole responsibility of the Winner. Winner’s companion must be of legal age of majority in their jurisdictions of residence, unless traveling with a parent or guardian. The terms and conditions of the tickets awarded as prizes will govern in the event the Show is not held due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. The Winner agrees to comply with all applicable stadium regulations in connection with the Prize. Sponsors reserves the right to remove or to deny entry to Winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the Show. The Released Parties (defined below) will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation of the Show.
The Prize is non-transferable and non-assignable, with no cash redemptions except at Sponsors’ sole discretion. There will be no substitutions for the Prize except by Sponsors who reserve the right to substitute a prize of comparable or greater value at their sole discretion.
NOTIFICATION: The potential Winner will be notified by e-mail and/or telephone by the Sponsors and may (in Sponsors' discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). In the event that the potential Winner does not respond to such Prize Notification within three (3) days of date of notification, a disqualification will result and an alternate Winner shall be chosen from among all remaining eligible entries. The potential Winner will be required to execute and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Publicity, within five (5) days of date of receipt. A disqualification will result and an alternate potential Winner will be randomly selected from among all remaining eligible entries if all required documents are not properly executed and returned within the specified period of time. Refusal or return of such documents as non-deliverable or potential Winner’s noncompliance with these Official Rules will also result in disqualification and cause an alternate Winner to be chosen from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, all entrants agree to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims against the Sponsors and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or use of any Prize or any travel or activity related to the receipt or use of any Prize. By acceptance of Prize, each Winner grants to Sponsors, and their respective designees the right to publicize such Winner’s name, city and state/province of residence and/or likeness in any medium now or hereafter devised worldwide without limitation and without additional compensation or consideration, notification or permission, unless prohibited by law.
GENERAL CONDITIONS: Released Parties are not responsible for printing or typographical errors in any Sweepstakes-related materials; stolen, late, misdirected, lost, damaged, garbled, delayed, incomplete, inaccurate, postage due or illegible entries or mail. Sweepstakes entries generated by a script, macro or other mechanical or automated means will be disqualified. The Sponsors and their respective agents and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of entry or prize reply information, or any viruses transmitted to computers of participants via the Internet, or for any technical or human errors associated with the Sweepstakes. If, in the exclusive judgment of Sponsors, this promotion becomes compromised in any way, Sponsors reserve the right to withdraw the promotion offer, cancel any method of entry, to void any entries submitted fraudulently or select winners from all eligible entries received prior to act that compromised the promotion.
Persons who tamper with or abuse any aspect of the Sweepstakes or website or who are in violation of these Official Rules, as solely determined by Sponsors, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by Sponsors or their respective agents. Sponsors shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Prize, and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the City and County of San Francisco, state of California.
Sponsors reserve the right, in their sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, Sponsors may elect to identify the Winner and award the Prize by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.
All online entries must include a valid e-mail address for the entrant. In case of multiple entries, only the first entry received will be considered. In the event of dispute as to the identity or eligibility of a Winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
WINNERS’ LIST: For a list of Winners (available after June 30, 2009), mail a self-addressed stamped envelope to: AT&T Park – Attn: KBWF Kenny Chesney Sweepstakes Winners list – 24 Willie Mays Plaza – San Francisco, CA 94107. Winner’s list requests must be made by July 31, 2009.
